The applicants are the owners of the property which has been let and occupied by various tenants. Boston Borough Council served an Improvement Notice stating that there were various hazards; the applicants sought to appeal the notice. Upon reaching the hearing date, however, the respondents did not attend. They also accept that the Improvement Notice did not satisfy the requirements detailed within the Housing Act 2004 s. 13(2).
The hearing was to decide whether damages should be awarded to the applicants.
