Primary Authority Toilet Advice Successfully Challenged
A High Court judge has ruled that Greggs must install toilets in accordance with section 20 of the Local Government Miscellaneous Provisions Act 1976.
The company’s Primary Authority (Newcastle City Council) had issued guidance regarding the provision of sanitary facilities in its outlets that had also been approved by the Department of Business, Innovation and Skills (BIS). The assured advice was subsequently challenged by Hull City Council.
Mr Justice Kerr said that the guidance was ‘flawed’ and that the lack of facilities in two of Hull’s Gregg’s branches was giving them an ‘unfair advantage’.
The decision is being appealed by BIS.
